Terms and Conditions LIVE NATION – ROCK WERCHTER

1. Who we are

In these Terms, "we", "us" and "Rock Werchter" refer to Live Nation Festivals NV. "You" refers to the customer.

2. Scope and acceptance

These Terms apply to every order placed on shop.rockwerchter.be. Before you complete an order, you must confirm that you have read and accepted them. You can save or print these Terms at any time.

These Terms are intended for consumers. Nothing in them limits the rights you have under mandatory consumer protection law.

3. Ordering and conclusion of the contract

  1. Add products to your cart and go to checkout.
  2. Enter your contact details and delivery address, and choose a payment method.
  3. Check the overview of your order. You can correct any errors at this stage by going back in the checkout.
  4. Confirm with the "Pay now" button. This creates an obligation to pay.

The contract is concluded once your payment has been successfully authorised. You will then receive an order confirmation by email, which includes these Terms. We store your order and you can request a copy by email.

4. Products and product information

We describe our products as accurately as possible, including materials and sizes. A size chart is available on request.

Colors on your screen may differ slightly from the actual product because of screen settings. If a product you receive does not match its description, you are entitled to the legal guarantee (article 9).

All products are offered while stocks last. If a product turns out to be unavailable after your order, we will inform you and refund you in full within 14 days, unless stated different on the productpage.

5. Prices and VAT

All prices are in euros and include VAT. 

Shipping costs are not included in the product price. They are shown before you confirm your order. The price shown at the moment of your order is the price you pay.

6. Payment

You can pay by Bancontact or credit card. Payments are processed securely by Shopify Payments (powered by Stripe). We never see or store your full card details.

Your order is shipped once the payment has been received.

You will receive a tracking link when your order is shipped. If we cannot deliver within the stated time, we will let you know. If no delivery time applies, we deliver within 30 days at the latest. If we fail to deliver on time, you may set a reasonable extra deadline; if we miss that too, you may cancel the contract and receive a full refund.

For deliveries outside the EU, import duties and taxes may apply. These are charged by the destination country and are your responsibility.

We bear the risk of loss or damage until you, or a person you have designated, receive the parcel. If your parcel is lost in transit, we will send a replacement or refund you, at your choice, without waiting for the result of any investigation by bpost.

8. Right of withdrawal

You may withdraw from your purchase within 14 days without giving any reason.

How it works

  1. Notify us within 14 days. The period starts the day after you, or a person you designated, received the products. If your order is delivered in several parcels, it starts the day after the last parcel arrives. Send us a clear statement by email (for example as a reply to your order confirmation), by phone, or using the model withdrawal form below. Using the form is not required.
  2. Return the products within 14 days after notifying us. Sending them in time is enough; please keep proof of shipment. We do not cover the return costs.
  3. Refund within 14 days after we receive the products. We refund the purchase price, using the same payment method you used, at no extra cost to you. 

Condition of returned products

You may handle the products as you would in a shop, to check their nature, characteristics and fit. If a product has lost value because it was used beyond that, we may deduct that loss of value from your refund.

Exceptions

The right of withdrawal does not apply to products made to your specifications or clearly personalised.

All products are covered by the legal guarantee of conformity of two years from delivery. This is separate from your right of withdrawal.

If a product is defective or does not match its description, you are entitled to have it repaired or replaced free of charge. If that is not possible, not done within a reasonable time, or causes you significant inconvenience, you may ask for a price reduction or cancel the purchase and get a refund. A defect that appears within the guarantee period is presumed to have existed at delivery, unless we prove otherwise.

Please notify us within two months of discovering the defect, with your order number, a short description and, if possible, photos. We cover the costs of returning the defective product and of sending a repaired or replacement product.

The guarantee does not cover normal wear and tear, or damage caused by incorrect use, washing contrary to the care label, or changes you made to the product.

10. Complaints and dispute resolution

For any complaint, contact us at merchandise@rockwerchter.be or +32 472 12 53 38. We aim to reply within 5 working days.

If we cannot resolve your complaint together, you can turn free of charge to the Consumer Ombudsman Service (Consumentenombudsdienst / Service de Médiation pour le Consommateur), North Gate II, Koning Albert II-laan 8 bus 1, 1000 Brussels – consumentenombudsdienst.be.

If you live in another EU country, the European Consumer Centre in your country can help you with a cross-border complaint.

11. Liability

We are liable in accordance with the law for the performance of your order. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our act or omission, for fraud, for intentional misconduct or gross negligence, or for any other liability that cannot be excluded or limited by law.

We are not liable for damage caused by your own incorrect use of a product, or by the incorrect use of your payment details by a third party, unless that use results from a fault on our side.

12. Force majeure

We are not liable for a delay or failure to perform caused by events beyond our reasonable control that we could not have foreseen or avoided, such as natural disasters, war, pandemics, government measures, or general strikes at bpost.

We will inform you as soon as possible. If the situation lasts longer than [30] days, you may cancel your order and receive a full refund.

13. Intellectual property

All content on this website, including texts, product photos, logos and designs, belongs to Live Nation Festivals NV or its licensors. You may not use it for commercial purposes without our prior written permission.

14. Personal data

We process your personal data to handle your order, delivery, payment and any questions or returns. How we do this, and what your rights are, is explained in our Privacy Notice.

15. Accessibility

We want everyone to be able to use our webshop. Our Accessibility Statement explains how the shop meets the accessibility requirements of the European Accessibility Act, which parts are not yet fully accessible, and how to report a problem. [Link to the published accessibility statement.]

16. Applicable law and competent court

These Terms are governed by Belgian law. If you live in another country, you keep the protection of the mandatory consumer law of your country of residence.

Disputes are handled by the competent courts under the applicable rules. As a consumer, you can in any case bring proceedings before the courts of your place of residence.

17. Changes to these Terms

We may update these Terms. The version that applies to your order is the one in force when you placed it, which is included in your order confirmation.
